Kumho Petrochemical accuses Flexsys of anti-trust
Seoul. Korea - Korea Kumho Petrochemical Company, Ltd. (KKPC) has filed a federal lawsuit against Flexsys America, LP (Flexsys) in the United States District Court in Los Angeles, California.
The lawsuit alleges that Flexsys has been restraining trade and fixing the price of certain rubber chemical products. The complaint also alleges that part of that conspiracy was an effort to drive KKPC from the marketplace by attempting to take away KKPC's suppliers, threatening their customers and attacking its business in the United States.
The complaint makes claims of conspiracy to restrain trade, monopoly and attempted monopoly under the federal Sherman Antitrust Act and seeks treble damages, attorneys' fees and costs, and an injunction compelling Flexsys to cease any unlawful conduct.
"We are announcing today the filing of a lawsuit to vindicate our position as a competitive importer of 6PPD into the United States," said KKPC's Vice President SC Kim.
"KKPC believes that our right to compete in the United States must be protected and we have been troubled by attempts made by our competitors to keep us out of this market. KKPC intends to vigorously compete in the United States' market and we intend to vigorously pursue our antitrust claims and to be made whole for the losses we have suffered in the past."
In February of this year, KKPC was cleared of charges brought by Flexsys over alleged patent infringements over the manufacture of 6PPD.
