ETRMA issues correction re Triangle industrial tyre
ERJ staff report (LMH)
Brussels - The European Tyre & Rubber Manufacturers' association (ETRMA) has released a correction stated that Triangle Tyre Co. Ltd's industrial tyre (size 17.5 R25) is compliant with the EU's REACH PAH (polycyclic aromatic hydrocarbon) requirements.
ETRMA had previously said that the tyre was non compliant, as ETRMA's testing programme showed that the PAH limit is exceeded in this tyre, but the marketing prohitibition under REACH only applies to tyres produced as from 1 Jan 2010. Triangle Tyres demonstrated to ETRMA that its tyre was produced in 2009 and is thus compliant.
ETRMA said in a 25 Oct statement that it appreciates Triangle's cooperation and is ready to work closely with its EU representative should any compliance questions arise in future.
ETRMA also highlighted that EU importers are ultimately liable under the EU law concerning non-EU manufactured products that they place on the EU market. The association advised that they should therefore discuss the EU compliance obligations with their suppliers and confirm compliance with all EU legal requirements prior to importation.
Regarding the PAH obligations in particular, ETRMA said EU tyre retailers should be knowledgeable of the production codes on the tyre in order that they can themselves be certain if the PAH restriction is applicable when they sell the tyre to EU consumers.
