Flexsys files new patent infringement complaint
Washington DC -- Flexsys America LP has filed a new complaint before the US International Trade Commission regarding alleged infringement of its rubber antidegradant patents.
Flexsys, a subsidiary of St. Louis-based Solutia Inc., accuses Chinese chemical firm Sinorgchem Co. Shandong and South Korean companies Korea Kumho Petrochemical Co. Ltd., Kumho Tire Co. Inc. and Kumho Tire USA Inc. of making and/or using Flexsys' patented antidegradant 6PPD and feedstock 4-ADPA without Flexsys' licence or permission.
Flexsys seeks a permanent injunction against the sale of Sinorgchem or Kumho 6PPD and 4-ADPA in the US, and also against the sale of any Kumho tyres made with these chemicals.
The company is still pursuing an earlier ITC antidegradant complaint against Sinorgchem and Sovereign Chemical Co.; the commission found in Flexsys' favor in July 2006, but a federal appeals court in Washington reversed and remanded the decision.
A Flexsys lawsuit against Sinorgchem and the three Kumho companies also is still pending before the Cleveland federal district court.
